Application for Citizenship

Citizenship is the status given to a legal member of the country. It involves rights, duties and privileges. Naturalization is the process by which a citizen of a foreign country becomes a United States citizen. People want to become citizens for a number of reasons. US citizens have the right to vote in elections, help family members immigrate, work in certain state and government jobs, and lastly they cannot be deported. An application may be filed by a lawful resident of at least 5 years who has made a home in the U.S. for at least the past 5 years (or 18 months out of the past 3 years if married to and living with a U.S. citizen). Applicants must be at least 18 years old, have good moral character and be able to pass tests on English and U.S. History & Government. As part of the process the customer will be provided with an Eligibility Test to ensure they are eligible to apply.

Application for Green Card

A green card offers permanent residence and gives you the benefits of living, working, and studying in the U.S. Your green card is basically good for life if you keep up renewal and eligibility requirements. Family-based green cards are one of the most common ways to obtain lawful permanent resident status in the U.S. You can apply for a family-based green card through a spousal, sibling, child, or parent relationship. A petition must be filed on your behalf by a family member who is a U.S. citizen or lawful permanent resident. Your family member must provide proof of the relationship that you hold and prove that they can support you at 125% above the mandated poverty line.

DBAs/Business Names

DBA is an abbreviation for “doing business as.” If you operate a sole proprietorship under a name that differs from your personal name (or if a corporation or LLC uses a name that’s different than what’s filed with the state), you’ll need a DBA. Expungement

Expungement of criminal records (either arrest or conviction) is of critical concern to anyone with a prior conviction, or contemplating a guilty or no contest plea to a current offense. Expungement is a term that means different things in different jurisdictions; generally, it refers to the cleansing of one’s criminal record, or the sealing and destruction of arrest and/or conviction information.

Incorporation

Incorporation means creating a new corporation. A corporation is an organization that is approved by your state to conduct business. It is a legal entity separate and distinct from its owners; a separate person in the eyes of the law. Most people form corporations to protect their personal assets because the owners of a corporation are generally not personally responsible for the corporation’s debts. This is called “limited liability protection.” The creation of this entity generally requires the preparation and filing of certain documents with The Secretary of State (or other appropriate department) in your state of formation, and running the corporation generally requires more formality than is required for most types of businesses. The corporation is formed by an incorporator, owned by shareholders, managed by directors and typically operated by its officers.

Small Claims

Small claims court is for regular people who want to take certain legal matters into their own hands. A small claims action allows an individual or business to be compensated by a party who has not performed according to an agreement or who had committed some wrongdoing. Typically, one brings a dispute before the small claims court that may not be significant enough to retain an attorney or to bear the expense of a full-fledged court case. The small claims department of the court is designated to settle legal issues and problems arising from contractual or service disputes or other claims. The maximum amount one is able to recover in small claims court varies according to the state you file in and can range from $2,500 to $10,000. A hearing date will be scheduled through the court. You and the person you sue will both be able to tell the judge your side of the story. You should bring all the evidence you want to present to the judge with you. The judge will listen to both sides and then make a decision.

Names Changes

There are a variety of reasons you may be considering a name change. Common reasons are divorce, dissatisfaction with your current name or the desire to change your child or family’s last name. You can’t change your name if… You are changing your name to fraudulently avoid debts, punishment, etc.; The new name will be intentionally confusing such as the number “8” or the symbol “!”; or The new name is racially offensive or obscene. Generally, a petition will be filed with the court citing your reason for wanting a name change to initiate the process. Depending on the court you file in, there might be a hearing that you may be required to attend and publication of the name change notice might be required in a newspaper of general circulation in the county in which you reside. If your petition is approved, you will receive an order of name change from the court.

Power of  Attorney

A power of attorney is a legal document that grants another person the right to act on your behalf. A durable power of attorney withstands the physical or mental disability of the person (grantor) giving the power. A durable power of attorney remains in effect even if the grantor becomes incapacitated and cannot make decisions for him or herself. A durable power of attorney is only effective if the grantor is alive. A springing power of attorney is an option as an alternative to a durable financial power of attorney. Instead of it being effective immediately, it “springs up” and becomes effective upon the incapacity of the grantor.
